The "Punishing you if you get it" thing makes me compare it to games where you die in one hit. Does that mean that those games are punishing you if you get hit, when you die in one hit? This game is hard, but at least you're not dead. Though you would think you might as well be. Games like Gradius are just cruel when you die in one hit, and you lose all power-ups.
If the game's sprite-based, yes, Dracula's hit box is wide on the bottom because it has to accomadate his cloak spreading out. Newer sprite-based games let you select a certain type of pixel that is "transparent" or doesn't count as actual solid in-game material, which fixes this.
