It had nothing to do with the other guy... That's a low-speed, hi-alpha plane. At high speeds the control surfaces will start to flutter. That flutter was the root cause of the failure.

@Aircraftfreak155 I think the guy he bought it from prob had a few hard landings with it and it caused the tail to be weak.

send it back and get your money back they ask what happend give them a link to the vid thats a falt in the kit.
