John Yoo returns to UC Berkeley for Fall 2009 after he left to the more conservative Chapman Law School campus for 6 months as a Visiting Professor.

John Yoo violated Common Article 3 of the Geneva Conventions, the United States Code (USC) Title 18 Section 2340, and the United Nations Convention Against Torture (UNCAT).

Common Article 3 has been admittedly violated, 2002-2006, under the Military Commission Act (MCA) by the Supreme Court precedent Hamdan v. Rumsfeld (2006).

So, it is up to further litigation to determine what extent the August 1, 2002 memo and other Office of Legal Counsel (OLC) memos were used by military personnel, and determine which agencies or individuals, i.e. John Yoo, Jay Bybee, David Addington and which agencies: CIA, DOD, OLC, were most culpable.

Are we ever going to see an indictment against any of these people: John Yoo, Jay Bybee, David Addington, Alberto Gonzales, George W. Bush, William Haynes, Dick Cheney, Philip Zelikow, etc?

Yoo argued that the United States is not bound by Geneva, or UNCAT in the "War on Terror" against "enemy combatants" More specifically, Yoo argues that the U.S. is not bound by the UNCAT treaty, due to a U.S. Reservation passed during the Reagan Administration.   • This is not how the court system works. An indictment, is simply a "formal accusation" and anyone can and should face an indictment for ANY allegation. People are "innocent until proven guilty" under the U.S. constitution, logically, this means that John Yoo is first indicted, at a minimum, and then either acquited or charged. If you don't want to cooperate with an indictment then you have something to hide. Simple as that.

    Using your logic, you don't have to indict anyone for anything.

  • The "torture" memo is not Yoo's work alone. Addington, as well as attorney general Gonzales and deputy counsel Tim Flanigan, and many others contributed as well, with the mastermind being Dick Cheney
