A Kanawha County Circuit Court judge says West Virginia's domestic violence programs are discriminatory because they deny abused men access to publicly funded shelters.

Judge James C. Stucky also ruled that the programs deny women abusers access to treatment.

As part of his October 2 ruling, Stucky voided rules set by the Family Protection Services Board, which oversees licensing for domestic violence shelters, advocacy certification and state funding for such programs.

Stucky said the rules distort lawmakers' intent and violate the West Virginia Men & Women Against Discrimination's right to free speech.

The nonprofit advocacy group sued the state board last year.

Stucky said the state programs operate on the false premise that only men can be batterers and only women can be victims.

  • Why can't society acknowledge that violent women exist in marriages? I'm a 40 yr old female and I've witnessed it myself! Not all women have halos above their head!

  • I still can't believe how sexist people are. The female abuser "is being denied treatment?" Well, God forbid she could be inconvenienced in between stabbing her husband and molesting her children. Good Lord...
