Wings ~ Divorce, American Style ~ Part 3

Stunned by the news that their "quickie" divorce won't be for another three years, Helen sadly resigns herself to life as Antonio's wife. But soon Brian's news about a green card lottery revives her hopes, until Antonio's call to Immigration reveals he was not picked. But Helen soon finds out Antonio lied about not being picked; when she asks about his deception, he answers that he was hoping that she would grow to love him. Much like his parents had done decades before while in an arranged marriage. It is not to be, however, and Helen asked Antonio for a divorce.

Okay, any law experts. The government guy implied before that if the marriage were to be found fraudulent, that they could go to jail. Now that Antonio has his green card, Helen and Antonio will get a divorce. Would they still be on the hook for whether the marriage was legitimate or not? I mean, couldn't they still go to jail what with the marriage so obviously being a fraud?
