Board certified criminal defense attorney Stephen Hamilton, practicing in Lubbock, Texas, talks about whether or not you took the breath test and what that means.
When you're out on the field, when the officer stopped, you gave you some field sobriety tests; often times they will ask you to take what is called a portable breath test. The test is actually not admissible in a criminal trial, and sometimes you get to the station and they ask you to take another test. This is with the Intoxilizer 5000, and not taking this test means the state can subject you to the refusal law. We can help whether you chose to take the test or not and even explain the refusal law.
