Andy Caldwell interviews USJF Executive Director Gary G. Kreep, Esq. of the United States Justice Foundation (http://www.usjf.net) on his Los Angeles radio show July 15, 2011 regarding the acceptance by the United State Supreme Court of his brief in the Jones case.
Mr. Jones was suspected by the United States of being involved in unlawful activities and a GPS tracking device was placed on his car by the government without have a warrant to do so.
The trial court upheld Mr. Jones conviction. Upon appeal, the conviction was overturned on the basis that the GPS tracking occurred both on public and private property. The Obama administration argued that it has the right to place a GPS tracking device on any person's car whom it suspects may, or might, at some unspecified time in the future commit an unlawful act and that no search warrant, or other court order, is ever required.
Mr. Kreep led a team of constitutional lawyers that filed an amicus brief arguing that the actual placement of the device without a court order was, of itself, illegal. The US Supreme Court - in a highly unusual move - agreed to hear Mr. Kreep's expanded argument and such is now before this court.
Andy Caldwell, a California-based radio talk show host, interviewed Mr. Kreep and this is volume one of two volumes. The second will be uploaded shortly.
