Gibson, like any reputable luthier uses aged lumber. When they purchased their hardwoods it was legal but now it is not. Gibson is the target because they are probably the largest user of ebony woods (not exactly known for their maple fret boards). It's all about raw materials. I cannot own an elephant's tusk but my ivory rosary is legal. Same deal with geetars now. You can't have a pallet of Madagascar hardwood, but you can own a guitar made of it, as long as it was made elsewhere.
