Under Section 245(i), undocumented immigrants can get their residency without leaving the US, thus avoiding the three- and ten-year bars and prevent separation from their families, jobs, and communities. Leaving the U.S., even to finish the immigration process, could trigger a bar that could keep the immigrant from reentering the U.S. for the next three or ten years

I-130 alien relative petitions (for family-based immigration);
I-140 alien worker petitions (for employment-based immigration);
I-360 petitions (for immigrants who can petition for themselves, including certain battered spouses and children)

Who can qualify under Section 245(i)?
An immigrant must have an immigrant visa petition or a labor certification application filed on his or her behalf on or before the cutoff date. In addition, immigrants must show that they were physically present in the United States on the date that 245(i) was legally extended.
