A tomato IS a vege. Fruit has both botanical & culinary meaning. Vegetable has only culinary meaning. The terms fruit (and flower/root/stem/leaf) and vegetable aren't mutually exclusive. Cucumbers, pea pods, okra, string beans, corn kernels, peppers, eggplant, and cotton pods are also botanical fruits, but you wouldn't call them fruits. You wouldn't say peanuts & almonds aren't nuts (botanically, they aren't) or call a strawberry a modified stem (look it up), so why get pedantic with tomatoes?

And I'm sorry to say, that something like this isn't up for debate, it's not an opinion, it's a fact. The American legal system doesn't have say in things they are not experts in, one may say that Saudi Arabia is just messed, but it wasn't long ago that both Canada, and America classified Black people as half people, and women as not being people at all. I couldn't care any less about what the courts say unless it's about legal issues.

It doesn't matter what the American legal system says, they're not experts in the matter. They ruled it that way as per how it's served, and farmed. Their decision is solely based on how they can tax things. But how they want to tax something doesn't change it's composition. In Saudi Arabia the courts ruled that women are only half people, that doesn't suddenly change women into half people. In my genetics, and botany class in university it's classed as a fruit.

Legally according to America Pizza is a vegetable, but that doesn't make pizza a vegetable. According to science it's fruit, because it's a fruit, not both. Just like avocados are also fruits, but most people eat them as veggies to.

A tomato is scientifically classified as a fruit. That's not an opinion, it's a fact put forward uniformly by the scientific community. Sorry bra. Tomato - noun - a glossy red, or occasionally yellow, pulpy edible fruit that is typically eaten as a vegetable or in salad.

It is eaten as a vegetable, but it is in fact a fruit.
