An empty courtroom with the sound of a gavel imparts the idea that due process in a trial requires that all issues of law be argued in the presence of the jury, so they can review the decisions of the bench on motions in reaching their verdict.

  • No, Larry Dodge and other FIJA activists stick to the old position that jurors be instructed to judge the law according to their "conscience", as though that could enable them to understand the legal issues involved in a case. But "conscience" is not enough. You wouldn't want judges ruling entirely on "conscience" and you don't want jurors doing that either. Jurors need to get the same legal arguments the judge gets.
