When is a sidewalk that is open to the public 24/7 cease to be a sidewalk open to the public? When a preacher stands on the sidewalk preaching a Gospel message and holding a sign that people do not want to hear or see. So, how do you remove a preacher from a sidewalk in that case? You tell him that it is open to all the people to use as a normal sidewalk except for preachers and then you slam him to the ground, put your knee on his neck, grind his face in the cement, handcuff him and haul him away....under the false pretense that he is somehow tresspassing.
