Except the core of the founding fathers army were regular uniformed troops, their the ones who won battles, and even the plainclothes militia had the sense not to use their families as human shields and their holy places as sniping posts and weapons depots. Plus British POWs tended to be treated pretty humanely, we didn't decapitate the whole of Cornwallis's army when they surrendered, we let them go.
