You keep insiting your position and text is clear. Let me assure you Permission and Endorsement do not have the same meaning especially pertaining to copyright law. That I have made clear. We are here because we support Gretchen's position that she does not endorse the use of her song in McCain's campaign. We also must recognize that he is within his rights to do this (as Janis's email even points out), we just feel it's in poor taste and bad form considering the songwriter's wishes.

Do not have any interest in getting into a bicker match with you, but I never ever mentioned a political party...please read what I wrote and please do not add anything...it is quite clear. In the past, the GOP has attempted to use Springsteen's BORN IN THE USA and after his disapproval, they simply stopped. McCain is, in this situation, A BOOR. The GOP has nothing to do with it. Clinton used a Fleetwood Mac tune with their permission.

NYstan1 you have an agenda and that's fine but it clouds facts. The use of Gretchen's song despite her protest is not immoral, it's just in bad taste and possibly disrespectful. I put down some facts regarding the use of Gretchen's composition and you charged in claiming that the law shouldn't apply to the GOP. That's un-american to suggest. I have no proof (do you?)that Mr. Browne or Myers are well versed in copyright law but i'm sure their lawyers and publishers are.

I am replying to my own email because I wanted to add something....both Mike Myers and Jackson Browne are well versed and informed regarding the copyright laws. They are making a statement as Artists. Neither of them, I am quite sure, have any objections to ANYONE using their creations in a FAIR USE context.
-
It should have been obvious that I was expressing an opinion.. The Fair Use law was not intended for Boorish Use. A Bully Pulpit is a Bully pulpit....remember the Swift Boat incident in the last election? Perhaps you also feel that creating a fog of lies in order to win an election is also fair use of the English Language. Moral behavior is the issue, and not some strict interpretation of a law.

I appreciate the clarification Hocusopus.
It sounds like nystan was expressing an opinion vs. facts.
The Jackson Browne and Mike Myers issue involved actual ads. For anybody interested, I found this little video from an attorney that goes into the law a bit more. Do a youtube search for Browne v. McCain: Copyright Violation.

Real women from real America...lovely
I live in Arizona and I'm voting for Obama. you cannot claim you put America first and then choose as your running mate someone who is inexperienced, inarticulate, narrow-minded and incurious because she happens to be a woman and is favored by the ridiculous right. That is just an insult to intelligent women and men.

How sad that Palin is fomenting such hatred and anger, and the only recourse the rest of us have is just to take a deep breath and keep reminding ourselves that America is AOU - All Of Us! Yay for Gretchen Peters for allowing this, which in some small measure counteracts McCain's awful mis-use of her song "Independence Day."
