  • The background investigations from today are not limited to the NCIC database. The systems used today accumulate data from the Court, all public records, and the DMV. Therefore, the distinction that Reckless Driving is not on the NCIC system is absolutely moot. The RD will not show up in my former cruiser laptop as a "mark" or "red flag," but the applicant (for US citizenship, job applications, clearances, insurance and all other practical matters) will have to disclose the conviction.

  • There are some who still say "VA's Reckless Driving charge is punishable as a class 1 misd but is only reported to DMV as a driving offense. NOT to your criminal record." This is a mistaken view with practical detriment. for the unwary.

    The Clerks of Court report the conviction to the DMV and not to the NCIC system. The only entry on NCIC occurs if there is a warrant from the Reckless charge, a rare occurrence. However, this is of little practical consequence.
