Rep. Nadler questioned Attorney General Eric Holder in a Judiciary Committee hearing on Tuesday. Nadler commended the Justice Department for its decision to stop defending the discriminatory Defense of Marriage Act (DOMA). For decades, Nadler has fought to protect LGBT rights, and recently re-introduced a bill that would repeal DOMA in its entirety.
Nadler also pressed the Attorney General on implementing reforms of the state secrets privilege in order to safeguard due process and provide for secure judicial review of assertions of the privilege. Without such review, the executive branch is essentially acting as its own judge in cases involving alleged state secrets. Nadler is the sponsor of the State Secret Protection Act, which would curb abuse of the privilege while providing protection for valid state secrets.
