The defense witness for Elston McCowan and Perry Molens made a claim that she did not step forward to provide counter testimony to police because she was afraid to do so. She said police officers were macing people. The truth is she stood next to a police officer who assisted her by shining a light on her cell phone. At no point did she provide any evidence, until 2 years later, when the defense needed a witness. The macing of Javonne Spitz occurred when Javonne continued to take pictures of Elston McCowan sitting on the curb. They told her to leave, and she refused. If scared, why would the defense witness continue to mirror Spitz's actions, as Spitz was being maced?
