Kenya is still seeking the right code to unlock the stalemate over the mechanism to prosecute the perpetrators of post election violence. International criminal court prosecutor Luis Moreno Ocampo says the Waki envelope will not be the only basis on which he decides whether or not to proceed with indictments. European Union diplomats say the cabinet must give a clear direction when it meets on Monday. As Rashid Ronald reports, June 2010 is the time-line by which Kenya must have that mechanism in place or wait for the inevitable intervention from the ICC.

  • ati gover is trying to show that kenya has the judicial mechanisms to set up a tribunal and so therefore no need to refer cases to the ICC...i don't buy it. why wait for annan, ocampo etc. before setting up the tribunal. what i know is all these leaders (PNU & ODM alike) have no plans of executing any justice. they just want to sweep everything under the carpet as they've always done. unfortunately, it aint' gonna work this time around. esp now that ocampo has taken over the case.

  • l agree this twisting tricks Tribunal brings us nowhere settle not less than justice at the Hague( soooooooo fed up)We need Justice.

  • This Gov. is like an old banger that needs pushing every morning.we know numerous other cases of impunity gathering dust in Kenyan "courts" the Hague,although not entirely in the interest of harmony,is probably very necessary.

Justice in Kenya is sham how can one trust it, if someone with two murders in his hands get only 8 months in jail?

  • They will also eliminate those witnesses who testify against them. It will be worse in terms of assasinations than Ouko inquiry by President Moi. Hii kitu iende huko Hague. I agree with with you!

  • Local tribunal means a game of musical chairs that will never end like goldenberg and anglo leasing. Kenyans want the Hague.
