(i) surely purporting to comply with a court order would be lawful justification,
(ii) why did the Administration not raise that issue before the judge in these proceedings so that he could rule on it? and
(iii) who exactly would challenge the Administration's action in court and what are the chances of that happening, the risks of losing and the consequences of losing?
If he's saying the action would be unlawful:
