A perfect day with excellent visibility and cloud base around 6000' . A perfect day for soaring and lot's of gliders flying around. Flight TRA537 is flying from Groningen to Eindhoven with a scheduled departure time of 14:45 local time. North of Apeldoorn TRA537 is maintaining FL080 in class A airspace. Just south of Apeldoorn TRA537 starts a descent. Abeam Deelen TRA537 descents below FL065, leaving class A airspace and entering class E airspace. In class E airspace only traffic separation between IFR flights is guaranteed, not with VFR traffic. Pilots of TRA537 are responsible for maintaining a good outside look to maintain adequate separation with VFR traffic.
Although all VFR traffic needs tot be equipped with a good working mode-S transponder, I think TRA537 descended to soon, taking a risk for a close encounter with VFR-traffic.
