  • @Shrekinize Why do I think Not. I really dont believe the supreme court heard a case involving a dui checkpoint. Would love to see this one. Btw, youre on a public road, I dont really need a reason to stop you other than to verify your registration or insurance.

  • @STARZFAN31 But like i said... nobody is willing to argue with the officer and take it to court because they know that it's even more of a hassle than to just fork over a license and reg.

  • @STARZFAN31 I guarantee that using avoiding a DUI checkpoint as your probable cause for pulling me over wouldn't hold up in court. The only problem is that no one is willing to go through all the effort of taking it to court or challenging the police. I know for a fact that making a perfectly legal U-turn while in sight of a DUI checkpoint does NOT constitute probable cause and is, in fact, a violation of the 4th amendment. This is a supreme court decision btw. No jurisdiction has it

  • @Shrekinize I beg to differ, in many jurisdictions, avoiding a dui checkpoint is illegal and is probable cause to stop a vehicle. As a former police officer, I know this quite well. Avoiding the dui checkpoint, on purpose, does constitute reasonable suspicion.
