  • You are a principled man that doesn't understand law. Are you seriously telling me that a jury, judges and attorneys should ignore the fact that the person was assaulted only because they were a minority. People use the term "special class" What is really being said is that they are a group targeted with violence more often. If a group of black guys attacked a white guy only because he was white and it could be proven. I am sure that would be taken into consideration as a hate crime. Its rare

  • And I suppose you're a law professor? ha.

While crimes are already assessed based on intent, state of mind, etc., you're saying that we should place different value on different types of hate & adjust the punishment accordingly. So a person who murders someone who cheated with their spouse would be punished less because their hate & anger is more justified than hate toward a race.

And you really think the psyche & motive of a crime is so easy to be proven without reasonable doubt? Get real.

  • I forgot the most important thing I was gonna point out! Hate Crime legislation includes National Origin and Religion. Of course that means you as a Mormon are one of those "special" people being protected. If you are attacked because you are Mormon it's very likely that it would be charged as a hate.

  • @samgd9 - Your comment is a wonderful illustration of the type of people who support hate crime legislation. Your most important point is, "hey, your part of the 'special' class who gets more protection...so you should support it".

I am a principled man. What I get out of it plays no role in the principles I believe in a subscribe to. That's why I have great respect for blacks who see the error of affirmative action & gays who oppose hate crime laws.

  • I certainly had the opposite opinion prior to watching this video, but you swayed me. Very well put, South Park.

  • @adhdboy699 i liked your question. Importantly, I see there was no answer to that question from you.

  • @wgmyler I agree with this video whole heartedly. "Hate Crimes" for different punishment foster resentment. It gives people reason to fear positive discrimination. Some feel less inclined to interact with people who are classed as "other groups" when it's so easy for legislation like this to blow situations all out of context. People feel frightened to volunteer with people viewed as vulnerable.

  • GREAT VID!!!

  • Its the same thing as affirmative action. As long as the government treats, and forces business to treat, people differently based on race, religion, etc., how can you blame society for doing the same?

  • @MrRogerdamn Sorry, but as long as the government continues to perpetuate the idea that people are different based on race, religion, national origin, sexual orientation, etc., how can you blame people for being racist, sexist, homophobes? Equal protection under the law; that's what I believe in. Apparently you don't, and either does our federal government.

  • @MrRogerdamn Please explain to me why exactly you think intent should change the sentencing or punishment for the crime. That doesn't make sense to me

  • @adhdboy699 If somebody sets out with the intent to assault or murder you becasue you are gay that absolutley should be taken into consideration in court and it sadens me you dont get that... Its about intent. If they assault or murder you and you just happen to be gay that is another story. If they assault you screaming faggot and knowing you are gay that changes the intent greatly, They are now assaulting with the intent to assault a gay person because they are gay!

  • @pcfriedrich I am no lawyer but you have heard of the terms intent and meditation? Yes, in answer to your question the two crimes you mentioned would be charged differently. Going out and killing someone with premeditation because they are a minority and you simply dont like that will possible get you in more trouble than two guys killing each other over a girl in a bar fight. This reality has come up before and the maker of this video blocks them for disagreeing.

  • @samgd9

So if I kill someone because they owe me $50, that's less severe than if I killed him simply because he is different than me? There is no logic in that reasoning.
