The comments posted earlier are well intended by misinformed.

As for the knowledge of this design defect, the Departemtn of Justice has an official Memo they sent to all prosecutors, and all law enforcement agencies detailing the defect and in effect, how to exploit it.

The memo was recently introduced into evidence in case no. 1215854

This is an "Evidential" Breath test used in many areas throughout California. You do NOT have to take a breath test unless you are under 21. You DO have to take a blood test to avoid suspension.

I never claimed to own the air I breath, but neither does the government. If they want physical evidence(as you so deem the air we breath)they can get it from someplace besides my lungs. Did i say anywhere in my post that I was trying to cover up a crime? No. I think driving while intoxicated is a crime. But its a loss of my constitional freedoms to take my breath or my blood. Before you accuse someone of trying to cover up a crime, you need to read what they posted. I dont even drink.

@dahooligan12 wow!  Studies have shown that people who drive when they are tired or texting are just as impaired (if not more) than a drunk driver. Do you suggest the death penalty for someone who texts? I don't condone drunk driving, but your solution would wreak havoc on society ESPECIALLY in the hands of corrupt cops and judges.

@BillMan2002 im not saying they should get the death penalty because some people just end up in a situation where they NEED to drive drunk and it could even be a very short distance. but if its a person who has other methods of transportation or something like that, but they CHOOSE to get behind the wheel, then i couldnt agree with you more, the death penalty would be pretty good.. because theyre putting a lot of other people's lives at stake

@dahooligan12 Well it isn't fair if they get the death penalty now is it? but, I do think they should put mandatory death penalty for almost every law. Harsher punishment means less crime. And yes, it is proven and does work! Look at the other countries that do this. American Boy got Whiped for throwing an egg at a car. That country never has any crime because the laws are so harsh!

Don't confuse the roadside test with one at a police station or hospital once a warrant is obtained. Not the same time!
