@Dracohero I'd rather pay 12 bucks a month for a subscription then play a "FREE" MMO that requires you to drop a couple hundred dollars if you want to bring your character up to snuff enough to take part in pvp or end game content.

Yeah, its already in open beta as camelface45 said, but the fact that it was linked on the front page of the official city of heroes main page probably means that i'm safe ;)
