There was no eyewitness to connect James to the inside of the theater.

Eyewitnesses said that there were 2 shooters, whose faces could not be seen.

My EMT-B instructor John Spera was the first Paramedic on scene at the theater shooting in Aurora Colorado. . I am very proud to say I learned from this man and one day hope to be a part of the Aurora or Denver Fire department. R.I.P to all who lost their lives that night. Firefighters unite and we will be there when the call is made.

Sicker thing is, that months later (Jan -2013 @ the time of this writing), this sicko STILL isn't going to trial yet, and his arraignment has been granted a continuance until March 2013...He and his lawyer are playing the court system like it was a game show :P
