I hear that hundreds of American cities have struck down the unPATRIOT act.
So who is that act not dead already ?
And what about the healthcare act, which mandates everyone must buy health insurance, being struck down by legislators all across America ?

Napolitano is intellectually sound and should have a wider audience. He understands the philosophical basis of America, liberty and the hatred of tyrannous government.
Check the Health Freedom, Dan Hannan video and expand the comments...I've posted a rant on the NHS which would make even Tyrant-in-Chief Obama think twice about nationalising health.

I don't want the government to run what I can do and what I can't do. I don't want their heatlh care. Slowly you will loose your freedom of choice. I like my health care just the way it is. You will not have the convience to go to your doctor, you will be put on a waiting list and if you are a baby boomer or you have elderly parents then you might as well forget it because you will have nothing. Keep the government out of Americans business.

It sounds to me like he's saying, the federal government has allowed the states to do with insurance, what it doesn't allow the states to do with other industries....SO, that being said, it is our OWN states we need to pressure, into accepting insurance competition from other states. Get busy harassing your state legislators to accept interstate business from the insurance industry. State Senate House not D.C.

cniht, it should be a federal issue for the reason the good Judge pointed out. regardless of how the states frame it, it in effectively presents a barrier to interstate commerce and interferes with the right to contract. If your state decided that all toenail clippers sold there had to be registered, it would be the same principle.
I don't agree with your "states rights" interpretation here because the commerce clause is there to prevent states from erecting barriers to commerce.

If we would simply follow the Constitution and abolish all of the unconstitutional laws, and stop all of the unconstitutional actions of the federal government, most of the major problems of this country would be solved.

Judge Andy makes a great point in this video. However, congress will continue to ignore the will of the people. It would cost them too much money out of their own pockets to listen to the common man.

I actually completely disagree with Napolitano and anyone else who has pushed this.
The assumptions put forward are false, and the premise accepted is that the Federal government can regulate insurance is accepted.
Currently it is a state rights issue. Any insurance company, even an out of state company, can sell a policy in another state. They must just file it and have it approved in that state. That policy must conform to state laws. Why should that be a federal issue?
