A young man injured his arm and went to a local emergency room. The doctors recognized he had a fracture and put his arm in a cast. They tell him to follow up in the orthopedic clinic, which is exactly what he does. Over the next seven weeks he is told that the bone is healing properly.

When the cast is removed, the patient can't believe his eyes. His arm looks like a roller coaster.

He asked the doctor "What is wrong with my arm?" The doctor said "Not to worry, with a little bit of physical therapy and massage this will go away."

It turns out when the patient had his cast put on, his broken bone was never put back into place (this is known as reducing the fracture) and properly aligned. Because of that, his arm was allowed to heal in an incorrect position.

Two months after his injury, he was told he needed to have surgery to break the bone again and to connect the bones using titanium rods and screws. He was going to have a surgical scar, restriction of motion and some nerve damage following surgery.

If his broken arm had been properly set and aligned correctly, he never would have needed surgery with hardware to correct this problem.

  • So how much did your client sue the first doctor for?

  • @mzrealm Did you know that in New York, we are not permitted to put a number down in the lawsuit papers in a medical malpractice case? It's true. That's why you never read or hear about people suing for medical negligence for outrageous sums of money. it is up to the jury to reach that conclusion about how much to award.

    In an accident case like a car accident or a trip and fall case, the attorney is permitted to put the amount of money they are seeking in the lawsuit papers.
