In Kollen Park on July 3, 2010 in Holland, Michigan during the "Celebration Freedom Festival" two Holland Police Officers approached me about my openly carried firearm. My firearm was in a Blackhawk Serpa CQC retention holster.

  • Google "stop and id states" and you will see that there are many States that require a citizen to show ID.

  • I wanted to add a little more background: Michigan is not a Stop-and-ID state. Meaning that if a police officer asks for ID, you don't have to produce it. They need Reasonable Articulate Suspicion (RAS) in order to detain. Then they can search you and take your ID. The US Supreme Court has ruled that carrying a firearm is NOT RAS to stop someone and detain them. It is unfortunate that people believe that they must do what the police want at all times.

  • @Skitzo365 you killed your own arguement with your own words. " reasonable suspicion", " criminal activity". "criminal suspects". Without these words this "statute" would be unconstitutional and therefore void and null. just sayin :)

Your jejune and rather tepid riposte bespeak volumes about you. If a person is obeying the law, they are obeying the law. Too bad you lack the integrity and intellectual honesty to understand that. I fear it is forever beyond your ken.

  • @MarineTheElk Can you give me an example of one and the statute that allows the officers to stop and ID someone without the suspicion of a crime having been committed?

  • @MarineTheElk Yes, but only if there is suspicion of a crime. If open carry doesn't need a permit of any kind, then there can't be suspicion of a crime, and thus, no ID needed.

    Even in Stop and ID statute states, you still need to show no ID at all if there is no suspicion.

  • @Skitzo365 however if you were a skitzo you would not be walking around with it in a holster, and going about your business, in this state Washington unless you are making gripping moves, or acting in a way that would really scare people such as pulling it out and brandishing it then they cant ask you squat. If you are concealed they can ask for your CPL but other than that cant do a damn thing.

  • @Skitzo365 yes they did up hold that but it is also up to each state to place such a statute so if the state is not a stop, and ID then this is nullified.

  • How is ownership/carrying of a firearm probable cause? If you own it wouldn't it be reasonable that you'd carry it? If a police officer ever gives me a hassle for carrying my lawfully owned firearm, I'll just hand him a copy of the U.S. Constitution. Have them start firing police officers over harassing citizens who are legally carrying (thus violating their civil rights) and that will come to a very abrupt end. Kudos to the guys who are asserting their rights!

  • @Wrongway1965 also look at the case of : Hiibel v. Sixth Judicial District Court of Nevada- the Supreme Court upheld state laws requiring citizens to disclose their identity to police when officers have reasonable suspicion to believe criminal activity may be taking place. Commonly known as "stop-and-identify" statutes, these laws permit police to arrest criminal suspects who refuse to identify themselves.

  • @Wrongway1965 Didnt stay it changed our rights. if you look at it from the original constitution. But in the past 120 years if not longer things have been added to it, changing the language from what it use to say to now to deceive people. I sent you a message.
