Why is this a gaffe - a socially awkward or tactless act? Joe Biden is entirely correct about the laws regarding war. Obama has greatly overstepped his authority.

Ultimately, the only difference in this regard between the Democrats & Republicans is WHICH wars they wage. Our military is still in Iraq & Afghanistan, dispite Obama's promises to end both immediately. Instead, this president has now started yet another costly war elsewhere.
