@TChrisWY Only when war is declared. So what the US did in Vietnam was a crime, not a war. There was not a declaration of war. The Dutch made the same mistake in Indonesia. Going to war without a declaration, therefore they called it a Politionary Act (?). Still, it was a crime also...
