So...I'm guessing the drunk driver had no insurance and that's why there has been no compensation yet? Sue him in civil court and own him for life if he doesn't buy your brother a new bike and some extra money for pain and suffering.

The insurance company for his wife are now coughing up as it was her car he was driving. Numbers are STILL to be agreed.

in australia, in the same circumstances providing the bike rider has insurance his/her insurance company will cover the costs and go after the person responsible themselves and recover the costs.. lesson, always have full comp insurance cause you never know what dickhead you will come across
