  • [Second Comment] The law was unequally applied, that I acknowledge. However, it was and arguably remains in the realm of state police powers (regulatory authority) to regulate marriage as the citizens of that state deem fit. The Warren court flagerently turned a blind eye to the legislative history of marital laws as well as the original intent of the framers of the Fourteenth Amendment. Justice Warren was a judicial activist whose constitutional mischief continues to manifest itself.
