  • On what legal basis does Vietnam have a claim on the Paracel Islands ? Just because it’s close to you doesn't mean it’s yours. Post WWII, japan renounces procession of these islands and under the instruments of surrender sovereignty reverts back to China. So you have no legal basis, couldn't hold on to it militaristically, what more do you want?

  • @chaoblinka: In fact, Vietnam SR has the most convincing legal evident of sovereignty over Paracel and Spratly archipelagos, esp. Paracel. It's not that Paracel is closer to Vietnam, as geographical position is not a key criterion to solve disputes. It's neither the so-called "historical" evidents which China PR is trying to "cook up".

  • It IS what you mentioned (but incorrectly) above: by the Treaty of San Francisco the Japanese had never returned the islands to any particular countries. Then the French, as the former coloniser of Vietnam, made its claims to those archipelagos legal. In 1954, by signing the Geneva Accords the French agreed to leave everything it had in Vietnam to Vietnam, and Paracel and Spratly were administrated by the South Vietnam until China PR by force invaded Paracel in 1974 and Spratly in 1988.

  • Personally, I think it is of the fairness to bring this case to the International Court. But China PR is enjoying its military domination over the South East Asian so much that it's preventing any efforts to find a just and fair solution. More desperately, China also claims 80% of the South East Asia Sea (or South China Sea), which is based on no "legal basis" (as you put it) at all. So, what do you think would be a possible solution?

  • @VN808 Dude, enough already. I don't know if you are stupid or just stubborn. Why the hell would China go to the ICJ when its not to its advantage. UNCLOS - Hey does the UN recognize the new name that Vietnam has created? "Vietnam has governed these islands for 300 years," Oh My!! Since Vietnam has belonged to China in many periods of history, does that mean China can claim the whole of Vietnam? REALISM - its a word you should get use to.

  • In order to have peace & justice in South East Asia Sea (S. China sea), greedy China should respect the international law UNCLOS 1982 & the conflict problem in this sea should be solved in International court.

  • @chaoblinka,

Do you know why China always refuse to solve the problem in SE Asia Sea(S China sea) in International Court??? Why is China ALWAYS AFRAID of International Court?

Because China can use CHEATING/FAKE informations to cheat stupid people, but China can not cheat International Court & lawyers!

That's the reason why China is using THE LAW of BANDIT GANG instead of the International Law of the Sea in SE Asia Sea!

  • @VN808 We've been going at this for a while and while I appreciate your attempts at convincing me of how wrong I am, I just want to say - I hope you have a day job that's a part from law, the arguments you put up are childishly idealistic and insidious. Because of you and the fanatical false passions your countrymen have raised, you have limited the options of your government. Every country has irredentist claims, but you have to be in a position to exercise them or shut the fuck up and wait.

  • @VN808 Brainwashed? The only person tha'ts brain washed is YOU my friend. You seem to think that because Vietnam admined these islands at some point in history, it is perpetually the sovereign realm of Vietnam. I've got news for you - when you are talking about islands with no native population, sovereignty is fluid.

  • In fact, Paracel & Spratly islands have belonged to Vietnam at least 300 years before French colonized (since 16th century)

We have many documents & maps from Vietnam, French, Spain, Italy, Portuges and England to prove that.

  • @chaoblinka,

The problem for you when you discuss about Paracel & Spratly islands is you are BRAINWASHED by China communist's cunning propaganda. It means your knowledge about these disputed islands are from China Communist's CHEATING informations. You need to do more research in this issue to FIND THE TRUTH.

For example, Chinese Communists BRAINWASH Chinese by FAKE infomation such as these islands belong to China long time ago, Vietnam just got the islands from French since 20th century!

  • @VN808 Communist? What is Vietnam then? Communism has nothing to do with it. We are talking about territorial disputes not pol ideology, You use the word communist as if its nazism, you think if V was dealing with the ROC, it would be any less protective of these islands? Ha!
