Complicated case this one... Border Control received a tip-off a nail bar business run by immigrants in Farnborough, Hampshire is employing and housing illegal immigrants.
It turns out the owner of the business (who is nowhere to be seen) is a man who applied for asylum in the UK in 1999 but astonishingly his case has still not yet been decided, 10 years on. Also rather bizarrely he was given permission to operate a business by the Home Office.
The man is living with a girlfriend who is also a asylum seeker but her application had been denied and she was released on bail and ordered to report to the local police station pending her deportation. She not only broke the conditions of her bail by failing to report, but also had given birth to a baby, presumably with the man she was living with, but failed to declare the birth with the Home Office.
The girlfriend had filed a new asylum claim and Border Control believe due to the arrival of the baby it's unlikely the couple will be deported. Clearly this couple know how to play the system.
The nail bar was employing two illegal immigrants from Vietnam, one of which claimed to be in the UK on a student Visa studying at a college in Oxford. Unfortunately for him his fellow illegal immigrant co-worker drops him right in it by letting slip that they both live in the nail bar owners house just 5 minutes away from the nail bar.
Border Control officers then question the Vietnamese "student" further to establish exactly where he lives and whether in fact he is studying in Oxford. He changes his story and claims to live in Hampshire and concocts a pack of lies about travelling on the train to Oxford everyday to study, but his story soon falls apart when is asked to show his train tickets or student rail pass. A phone call to the college revealed he was not studying but was in fact working at the nail bar full time. When he was informed he was being arrested and searched he was quite surprised. He was detained for 5 days before being deported to Vietnam.
It turns out his co-worker had been denied asylum in the UK and had also been denied the right to stay with a spouse, but had remained in the UK anyway as an illegal immigrant for 8 years. He was arrested on the spot questioned at the police station, but as usual released on bail.
A search of the nail bar owners house revealed evidence he had been living in Hampshire and there was another illegal immigrant woman from Malaysia living there who claimed to be a friend of the nail bar owners girlfriend visiting the UK for two weeks. Naturally she claimed not to have a passport, knowing she wouldn't be deported without it.
Eventually the Malaysian woman comes clean and says that the nail bar owners girlfriend is her boss and is holding her passport. A search of the house revealed the passport and the Malaysian woman was deported.
Astonishingly despite the nail bar owners girlfriend being an illegal immigrant and her deception with Border Control, she was not arrested and was free to go. The nail bar owner was fined £10,000 for employing two illegal immigrants.
Few comments and observations on this case...
Again this case highlights the major failings and loop-holes in the UK's current Border Control procedures for dealing with illegal immigrants. It should not take over 10 years for a decision to be made on asylum. Asylum seekers should not be running a business or living freely. They should be held in an asylum detention centre. Until such time as asylum is granted they have no legal basis or right to be in the UK. As this case clearly shows, allowing them to live freely only makes it less likely they will be refused entry and deported since they're able to make a life for themselves and have children.
Border Control officers seem to be somewhat lapse and naive in how they deal with these people a lot of the times. To anyone watching this video it's probably obvious that the owner of the nail bar business is the young woman who is an illegal immigrant and it's merely been registered in her partners name. This is a direct breach of the law and is grounds to deport them both.
Another issue relates to visitors on student Visas. The UK seems to lack any ability to track students and root out bogus students. If the UK adopted a centralised system colleges and universities could provide information about students who don't attend and then Border Control could round these people. Bogus student visa's is now the easiest and principle way illegal immigrants gain entry to the UK. With the rapid raise in bogus students it's clear the UK needs a much more organised and robust approach to dealing with this.
Finally, the fine should of been £30,000 not £10,000, since as the law stands, anyone employing illegal immigrant workers should be fined £10,000 for EACH illegal worker. Why Border Control gave this couple such leniency in view of the level of their deception and status is a baffling.
Viets, Thai, Chinese... they send girls, have a baby or two in the UK.... brings more illegals, make money.. you can not kick them out... why? I have a baby... soon or later, England will belong to all illegals, the British will be the second class citizen in their own country..Tthe illegal know all the ti=ricks by now. It's all ready too late. you send them back in Asia, they made enough money in the Uk and they will buy a brand new passport with a different name and come back soonest possible.

@hu63920 That's right, that's why we need radical changes implemented fast, or a completely new way of governing that has the will and the moral backbone to take the necessary measures. The human rights of illegals should not even be a factor worth considering. If they have babies, too bad..they're rounded up and deported. Once arrested, they're DNA tested, eye scanned, finger printed and blocked from re-entry permanently.

The US has changed over to creating "illegal alien suspect" detention centers, which is kind of a jail specifically for undocumented workers. They are held there until trial date. I think the UK and the rest of Europe should do the same. Sending illegal aliens free is risking flight and more burdensome to the police .

@freeqwerqwer Absolutely! Great to hear someone speaking common sense. That is the only way to get to grips with the massive problem of over one million illegal immigrants roaming freely in UK. Round them up, and put them in purpose-made holding prisons until they can be deported. The government here is too short-sighted though. They wont commit the money to building and running those prisons like the US has. But it's a cost which will be saved in all the tax loss and policing costs.
