Human Rights, and in the United States case Constitutional Rights are set in place to protect the people in these situations. Americans are always proud of their rights given to them and they love to express these rights. It is easy when life is continuing normally but these rights exist especially when things go wrong. Human Rights and especially peremptory norms should never be violated. If he is indeed a terrorist, give him his trial and punish him as a terrorist. Do not punish the innocent

Everyone is entitled to a fair trail in a court of law, that's the foundation of all free and fair society's you can't just put someone in prison for over 7 years because you think they may have planned on doing something. Thank God Obama is in the whitehouse maybe now America can find its fairness and humanity again.

They tried that in my country it was called internment. The British security forces rounded up all those they suspected of I.R.A membership and imprisoned them without trail so as to ensure they didn't commit any terrorist offences. The net effect of this injustice (many were innocent) was to swell the ranks of the I.R.A and essential insure the war would last decades. Injustice will only serve to make terror attacks on the U.S. more likely not less. America is better then that.
