I don't get it. Why was CN taken to court by the City of Burlington, and why is CN now being forced to bear the brunt of the cost of the underpass? The tracks were there first, and in general it is the city that must foot the bulk of the bill if they want an over/underpass built. RR's should not be responsible for grade separations for roads that were built later after the RR was built. Am I missing something here?

I watch trains here all the time and I understand that it blocks traffic greatly. I think it is a great idea but I also think that it is total bull that the city of Burlington took the CNR to court. I just don't understand why the CNR would have to pay for the construction??? It is beyond me why the CNR was taken to court. The CNR just does there job..... runs trains. Sorry if I am wrong but I just don't understand the whole issue??
Why was CN found liable? What did they do?
