@Orthodoxcrusader  Being unarmed is not the same as having laid down your arms.* To lay down your arms is to surrender. To be unarmed means you're an idiot who lost his weapon or got life-and-death. Fleeing is another word for retreating, a tactical movement to avoid capture and conserve combat power. It doesn't place one hors de combat. Shooting an unarmed soldier in retreat might be against the ROEs for some people, but it's not against international law.

@Orthodoxcrusader Sorry, let me restate my whole comments. Actually, it is legal to kill fleeing unarmed or armed soldiers.

They would just flee, regroup and attack you again.

If they are not actively trying to surrender, then they are still combatants.

If they were to surrender, why they tried to flee into Iraq instead of surrounding to coalition forces? They went the wrong way. You don't want to let them retreat, pick up their weapons again later, and counterattack with much much worse.
