@jakeonethird You didn't hear the audio? Listen to all the taunting of the police. There wasn't just one guy the police were dealing with, there were several and many hooligans yelling at the cops you don't see that were standing on periphery. He was resisting arrest. When you resist arrest, you are basically saying "anything goes". The cops are trying to restrain him and control others, but no cooperation. A taser has a trigger and so does a gun, he meant to taze the hooligan not kill him.

@whitesonful I am trying so hard to see your reasoning here, but sometimes explanations just reach too far and are way too ridiculous. This shit was not a mistake. Why are you even giving him the benefit of the doubt?

No, under normal circumstances this wouldn't have happened, but listen to the audio. There is jeering, verbal attacks loud and angry against the police. It is clearly not a laboratory situation where it is quiet and peaceful. Why does the suspect resist arrest? When you are resisting arrest, you are increasing the probability of a mistake happening. Trained proffessionals under high stress make mistakes too. Why didn't the victim cooperate originally? If he did, I doubt this would've happened.

You are telling me a trained officer cant tell the difference between a taser, and a pistol?
He has at least 4 cops there backing him up, the situation is clearly under control, and the "suspect" is being kneeled on by him, and his fellow officer.

elated He pulls out the gun clearly (taser is in a TOTALLY different pouch), and puts it to his head before shooting him. There is no way on earth he could have mistaken that shit.

@KirkGaming yep, I agree with you. Look at all the high stress dangerous situations the police have to endure on a daily basis. The cop made a mistake. But, I think the mistake was understandable considering the confusion that the resistors were riling up. Try doing anything that you can normally do under regular circumstances when a group of people are yelling every swear word, racist slur, rude and oppositional shouting at you, and not cooperating physically, and see if it's error free.

Why was the guy resisting arrest and swearing at the officers? Amongst all the confusion, it's easy to see that the officer was trying to tase him, which is police policy for arrest resisters. Yes, the officer admitted to accidently using the pistol opposed to the taser, but you can see they weren't getting any cooperation which was the reason for all the confusion. It's simple, when an officer is making an arrest, you are quiet and follow directions so accidents like this don't happen.
It is completely impossible to mistake a gun for a taser, they are kept in completely different places on a cop's holster belt and have different weights, grips and triggers. This is cold blooded murder, and a two year sentence is a slap in the face of the family and all Americans. Do not forget this, avenge his death and seek JUSTICE!
