OAKLAND — A BART police officer struggling to handcuff a 22-year-old man, stood up over the facedown Hayward resident and fired a single shot into his back while a handful of officers watched, a video taken by a train passenger apparently shows.

It is completely impossible to mistake a gun for a taser, they are kept in completely different places on a cop's holster belt and have different weights, grips and triggers. This is cold blooded murder, and a two year sentence is a slap in the face of the family and all Americans. Do not forget this, avenge his death and seek JUSTICE!

@KirkGaming yep, I agree with you. Look at all the high stress dangerous situations the police have to endure on a daily basis. The cop made a mistake. But, I think the mistake was understandable considering the confusion that the resistors were riling up. Try doing anything that you can normally do under regular circumstances when a group of people are yelling every swear word, racist slur, rude and oppositional shouting at you, and not cooperating physically, and see if it's error free.

Why was the guy resisting arrest and swearing at the officers? Amongst all the confusion, it's easy to see that the officer was trying to tase him, which is police policy for arrest resisters. Yes, the officer admitted to accidently using the pistol opposed to the taser, but you can see they weren't getting any cooperation which was the reason for all the confusion. It's simple, when an officer is making an arrest, you are quiet and follow directions so accidents like this don't happen.

@CentralValley187 I agree with you here, That police officer should have been thrown in jail for a long time. It was miss used force entirely, and practically murder. I thought you said to start assassinate all cops, which I disagreed with.

@KirkGaming No, I don't hate all cops I understand that we need them in our society. I was only talking about these cops, like the one in this video, who only got two years for killing someone. With soft punishments like that, I'm sure he wouldn't be afraid to do it again.
