Regarding "lease forfeiture" disputes, this is becoming an important issue for landowners because of the Marcellus and Utica shale development. Many landowners are burdened by old leases with non-producing or little-producing wells. Consequently, they are prevented from leasing their property to developers of the deep shale formations.
This is a complicated area of the law. This depends on the language employed in the original lease regarding the "term" of the lease. It also depends on the current situation. Is the well producing? How much? Are royalties being paid? If so, how much? There is case law in Ohio on when a court may declare a lease forfeited because of non-production. The results will depend on the previously-mentioned factors.
