Pornography is not protected by the 1st amendment but rather by the 5th amendment and its contract clause. That is why its sale and display is controlled by "time, place and manner" restrictions and age restrictions. Porn has nothing to do with freespeech, in fact it is the antithesis.

  • I am saying that pornography has no first amendment protection. Larry flint spent millions portraying himself as a defender of the first amendment and all he did was legalize slander and libel. The same with Murdoch, he got a supreme court ruling that Fox news casts could be outright lies and still be presented as legitimate, neutral reporting. so stupid people now think that if porn is available, then their 1st amendment rights are still protected. It's a social disconnect!

  • It is a freddom of contract not a freedom of speech. commercial speech isd not supposed to be protected by the first amendment that was just the corporatization of the constitution. It's hard to discuss first amendment issues when so few people have investigated the "opinions" they have been sold.
