Residing in Boston, he travels widely in this country and abroad. Prior to becoming a columnist he was based in Washington, D.C., covering the Supreme Court, and in London as its bureau chief.

Well, right or wrong, the judiciary HAS read concepts into the first amendment that are not immediately apparent from the language.
The idea that legislation must possess a "clear secular purpose" is one example of this.
I agree with the sentiment, but it doesn't come right from the text of the amendment.

And Republicans use the same Due Process clause to argue for restrictions to punitive damages, while turning around and decrying the use of Due Process to strike down anti-abortion laws.

Activist judges are on both sides. It is hardly a useless phrase. Democrats and Republicans do it. Republicans ignore 14th concering gay marriage. Democrats ignore the simple right to contract (implied by the right to property) through minimum wage.
