i dont think he is dead he is incapasitated according to wiki pedia.
he abandoned the body he was in when he fought sasuke,then sasuke absorbed him later when sasuke fought itachi orochimaru wanted to take over sasuke body which resulted in itachi saling him away.
i hope some how he gtts unsealed.
