You can stand on public property and record anything you can see while standing there, including the interior of buildings, but you can't stand (or sit in your car) on private property, including their drive thru, since that's part of their property, and make either an audio or video recording without the permission of the property owner. Not that I expect that mcdonalds will be like z0mg I'm going to sue this mofo, but the fact is that they could.
