Speaking on the Senate floor today, Sen. Tom Coburn rejected the judicial philosophy that embraces the use of foreign law in interpreting the U.S. Constitution. Dr. Coburn also pointed out that while then-Judge Sotomayor agreed during her confirmation hearing that foreign law should not be consulted in our courts, she explicitly cited it during a recent Supreme Court opinion.

  • It's about time! I am so tired of the U.S. being subject to the approval of other nations! We were the strongest nation because of our constitution. Now, we are weak and so overly concerned about what some tiny nation which is screwing up its own societies thinks about us. Keep up the good work senator!

  • Blue boy I think you're wrong there about what a forgien nations thoughts are.

WE are a different society and have different values and morals. The constitution is pretty clear about what law is. Our society determines what is moral.

  • The US Constitution prohibits 'cruel and unusual punishment', but what constitutes 'cruel and unusual'. Well one source of consensus on that is the opinions and actions of other civilized countries. Their law is not dictating our law, but their consensus is helping us define something within our Constitution.

If the world feels life sentences for juveniles is wrong, it is s pretty safe bet that that consensus falls within the definition of 'cruel and unusual' in our Constitution.
