So what does the Constitution actually say? The Judge settles the question (from Glenn Beck Show 8-19-09).

Judge Andrew Napolitano fills in for host Glenn Beck, and at the end of the program he talks about how the proposed (or any) government takeover of health care and/or health insurance (or any other business) is not supported in the Constitution as one of the powers of the federal government.

I've asked so many brainless Liberals where Barack Obama gets his Constitutional power to "give" us nationalized healthcare. They have one of three answers:

1. They have no answer at all. Well, I always love that.

2. They say it's in the Preamble as "insure domestic Tranquility" or "promote the general Welfare." FYI, folks -- The Preamble isn't law.

3. They say it's in Section 8, Powers of Congress, where it reads "provide for the common Defence and general Welfare of the United States." Since when does "general welfare" of the USA mean "absorb private industry into government control?" Also, it does not spell out "provide free healthcare to the People of the United States."

4. And as the Judge points out (thought it's never been said to me personally), it's in the clause "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes," more specifically, the interstate commerce part. Again, making certain interstate commerce runs smoothly and justly has nothing to do with taking over private industry and providing free healthcare to the People of the United States.

Personally, I'm against the government taking over private industry, I'm against the government developing socialized medicine, and I'm against Obama's constant push toward Socialism. This video is part of my argument against further empowerment of the United States federal government.

I'd like to offer some artistic criticism of this video. I think the framing on the Judge is excellent, it is very proper for the format of the show. I really like the opening graphics which include presidential portraits which merge into the Glenn Beck logo. And I like how clean, yet bold the show's logo is. The set is a very flexible use of space, with the chalkboard in the background on a riser. And the background is bright an energetic.

    Seems like the authority is enumerated right there.

    That does not mean "welfare checks" for individuals. Nor does it mean taking over the medical industry and nationalize it and run it or the insurance business. You are a moron.

    4. Define "obsessed." Liberals use military supremacy against their own people, which is in the works.

    7. Obama's Admin is obsessed with Nat'l Security against his own people.

    The Feds are overstepping their bounds on healthcare...according to the Constitution.

To me, it means the congress has the power to pass whatever laws they deem necessary and proper to provide for the general welfare of Americans. In fact, it not only means that - it says that exactly.

    --The "implied powers" decision. What the Judge said was not wrong, nor does that case change what he said. The implied powers are about doing things in furtherence of the express powers, not those that have nothing to do with the express powers. Taking over the healthcare, insurance, & banking industries is not allowed because doing so is not in furtherence of the express powers under the Constitution.

  • Welfare is a joke that was made to get Democrats votes. There wouldn't be a Democrat in Congress today if they didn't support bribing the people with welfare. Welfare makes us week and it's not governments job to solve all our problems,but obama thinks it is. We can easily replace it with job insurance run by the private sector and it's competitive. So we don't have the problems with other insurance companies. Bring back the Constitution and Capitalism America. Bring it Back!!!!!!!!!!!!!!!!!!!!!
