The, now infamous, Obama constitution "flaw" quote, now with context! Interpret as you will, comments are allowed on this video. My interpretation: he's saying in America we tend to view certain moral issues as regular problems that we have to compromise on; like with slavery(3/5th as example), gay marriage, the environment, etc. Oh I also interpret that the original clip was edited by desperate republicans to make it sound bad.     The 13th Amendment was actually not needed. Had the courts simply enforced the letter of the Constitution (including the Declaration of Independence) as it was written.

    amendment 13, Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

    This law does not actually address blacks specifically but forbids slavery of any person.

    Obviously it's the foremost legal document of the US. That's a given. It shouldn't need to be said, it should be implied any time anyone is referencing US law. You are correct, however SCOTUS also has the power to interpret the Constitution, so ultimately, they decide what the amendments mean in comparison to the rest of the laws.

    The decision to free the slaves and give them rights wasn't made until the 13th amendment, many, many years after the fact. The Constitution gave SCOTUS the ability to interpret the Constitution and laws, they interpreted men as not including slaves. That's really all there is to say on the topic.

    The Declaration of Independence is NOT a legal paper. It's a declaration of war, not a set of laws. What it says does not matter. The Constitution does not mention God in any way except in the signature, and that's merely as a time reference. The Declaration has no place in any legal decision in the US. It's a great document for its time, but you can't reference it for US law. It doesn't have anything to do with US law. At all. Furthermore, slaves weren't "men" according to SCOTUS.

    Also I would argue that the Constitution is not only a legal document, but THE legal document that all other laws have to follow. If a law doesn't meet Consttutional muster, the Supreme Court has the legal obligation, in deference to THE US Constitution, to overthrow the law. The Constitutional Amendments contained in the Bill of Rights clarify or enhance or more firmly state components of the Constitution that were, through time, challenged.

    Actually, Vylsith2, The reporter asked POTUS what he thought of the Declaration and of the Constitution. G-d is mentioned as "Nature's G-d" and as "the Creator" and as the "Supreme Judge of the world" in the Declaration. This esteemed document also refers to "all men," and as a woman, I'm sneaking myself in there as well. A document that encompasses "all men," would be remiss in breaking "all men" down into races, because to do so would endorse that there are inherent differences between races.
