Cold, Rainy morning. Flood warnings in effect. Might there actually be a break today from the daily, continuous year round noise outside our "residential" windows ?
A break after the long winter of sleepless nights & long days listening to a bulldozer loading trucks with salt over & over, among many other things. There couldn't possibly be any Lawn Care work today. No need for the constant stream of loud trucks,tractors,bulldozers today. So we might get a moments peace where we live, right? ..... WRONG.

Once again, despite pouring rain, awoke to the sound of Trucks in & out, then by the rumbling of a large Tow Truck pulling in & idling at our bedroom window for 30 minutes while a car was delivered.
The property maintenance area (that shouldn't be located where it is in the first place) has, once again, turned into a "Garage". Seeing & hearing cars being pulled into the "shed" & worked on is not unusual here.
According to the Rules & Regulations of our Association, no one is allowed to work on vehicles here. The rules also tell us that no one here is allowed to make Noise, Vibration, Soot/Odor etc that disturbs another Resident.
Yet they stuck this operation right at our unit and we are forced to live in just those conditions every day...and even some nights! We're told to MOVE & sell ! In this economy, it's not that easy to do .... and why should a resident be forced to?
So, how is it that Employees of a Homeowner's Association seem to have more Rights than a Homeowner/Resident and do not appear to be bound by the very same Rules that apply to everyone else? How does that happen? Well, in our experience....it's "allowed" to happen by the very same Homeowner's Association that is in place to enforce the rules. Also in our experience, the law is not helpful when it comes to enforcing issues like this. When Commercial-type Operations pop up feet from a home in a "Residentially Zoned" area, we're told there's nothing that can be done because it's a development & considered "private property". So, using that example, if a murder occurs here, I guess we just call our Homeowner's Association??

Anyway, here we are years later. We've been through HOA, Police, Township Meeting, Lawyer etc. We've suffered further false accusations toward us. One that almost landed one of us in Jail ! And we won't even talk about the "Judicial' system. Unbelievable! This is the kind of stuff we only saw in movies and are still in shock that it can really happen this way for a regular, law-abiding citizen who's just trying to find some peace & resolution to a very harmful situation in their Home Life.

We haven't posted anything in a long time but as you can tell, it's not because there hasn't been a LOT to post about! This has been an extremely stressful ordeal for us and has taken a toll on our health & well-being. Only recently did we discover another route to take in order to find some resolution to this issue. It's either resolution or move ...and so far, moving hasn't been in the cards so here we are.
