Govt determined to set up tribunal

Indications are rife that the Government is still determined to have a special tribunal set in the country to investigate post election violence suspects, even as the ICC prosecutor plans to open the Waki envelope tomorrow. Foreign Affairs Minister Moses Wetangula and his Lands counterpart James Orengo insist that the ICC only intervenes in failed states of which Kenya is not.

Article 28 of the Rome Statute provides that a person effectively acting as a military commander shall be criminally responsible for crimes under his effective command, authority or control, for failure to exercise proper control over such forces. The forces under President kibaki committed crimes and he knew that the forces were committing crimes but failed to take necessary and reasonable measures to prevent commission of such crimes. This is criminal liability on his part. Time has come!

international crimes were committed during post election crisis on a wide and systematic scale involving Kibaki, Raila, Uhuru, Michuki, Ruto, Kalonzo a crucial threshold in investigating crimes of this nature includes murder, extermination, deportation or forcible transfer of population, torture, sexual violence, persecution and other inhumane acts, there are grounds for investigation of the top leadership 4 crimes committed by their subordinates under the principle of superior responsibility.

Sorry Mr. E. Wabukala proclamation of social truth and justice will be found in Hague. Can anyone remind me of any court that tried the so called leaders of Kenya and made them pay for their evil deeds?. That's the reason we can't have any confidence in our judiciary.
