NEW CASTLE, Pa. -- A New Castle woman said her child was taken away from her after the results of a drug test came back wrong.

The woman said she tested positive for drugs after delivering her child because she ate a poppy seed bagel before giving birth.

Elizabeth Mort said Children and Youth Services came to her home three days after the child was born at Jameson Hospital to remove the baby from her home. CYS officials said her hospital bloodwork showed that she was using opiates.

According to the Pittsburgh American Civil Liberties Union, the bagel's poppy seeds provided the false positive.

Sara Rose of the ACLU said CYS may have violated the law.

"One thing I think is a violation is the fact that Lawrence County CYS immediately got a court order without the parents present to remove a newborn baby based solely on the hospital's report of a positive drug test," said Rose.

Jameson Hospital released a statement to Channel 11 News saying that they were only following the law.

A Pennsylvania House Bill 2760 that passed three years ago allows hospitals to test a mother's blood to protect newborns. But the ACLU said Jameson hospital went too far and failed to consider what Mort might have eaten.

The ACLU is representing Mort. Rose said they are working toward filing a civil rights lawsuit on her behalf. The child has been returned to Mort.

Jameson Hospital released a statement saying, "We have initiated an investigation to compare our standards to other community and regional hospitals. And if necessary, we will advise our reference lab to critique their standards for consistency."

  • I hope that kid grows up to sue the CPS for depriving him of breastmilk and leaving him with an inferior brain as a result. His corpus callosum will now be smaller than if he'd been breastfed, reducing the extent to which he'll be able to concentrate and organise his thoughts, i.e. will push him closer to the 'AD/HD' end of the neurological spectrum. I'm on the diagnosed AD/HD end of that spectrum anyway and if anyone had contributed to my small corpus callosum I'd sue their neuron-killing arse.

  • @CharinZain im pretty sure the side effects of alcohol and tobacco are worse than marijuana. think about it, noone has ever died, or gotten cancer from marijuana use. now look at alcohol and tobacco. soo many people have died from them and formed addictions to them yet they are LEGAL and extremely unhealthy. so should something that is not (physically) addictive or lethal be illegal while two worse substances remain legal and easy for underage young adults to acquire?

  • @cheesemaster1000 you are more likely to get cancer by drinking from a styrofoam cup. Honestly, smoking anything is not healthy for you and that is why more people need to vaporize.

  • I have just learned something disturbing. US lawmakers are currently attempting to force people on welfare, unemployment and other public benefits to undergo drug screening. It passed in florida but was overturned and is now on hold for further review.

  • @Resinworks You can't say that 'noone' has ever got cancer from cannabis, because we simply don't know. There are studies that show it can cause cancer, and others that say there is no link.

  • @tommy9834 wouldn't it depend on the person? It's like how some people can have a bottle of beer and get totally wasted while other ppl can drink five and not even be buzzed. I think it has something to do with your weight and your liver maybe.

  • Of course a poppy seed bagel can cause a positive drug test result. There are trace amounts of codeine and morphine in each poppy seed. That's why you can go to the Whole Foods store and buy a pound of bulk poppy seeds and use lemon juice and warm water to extract the morph.... you know what? Nevermind... I don't know what I'm saying.
